Release and Hold Harmless

By signing below I fully acknowledge and agree to the following on behalf of myself or my child:
1. Voluntarily choose to participate in one or more of the following equestrian activities or events provided by Southern Bright Stables, Reign Equestrian and Gemini Brittany Pledger, hereafter known as “REq”: Recreational Riding, Riding Instruction, Special events on or off establishment’s grounds such as Trail Rides and Horse Shows, or any other activity or event provided by REq. I am fully aware that horse activities and sports involve inherent dangerous risks of serious bodily injury and/or death.
 

2. By participating in any of the above listed activities and events, I assume any and all risks of serious injury and/or loss and agree to fully indemnify and hold harmless REq, Gemini Brittany Pledger, REq additional trainer/s or any of its Volunteers, Employees,Contractors, Associates and Assistants, and owners of host properties, or the property/properties located at Southern Bright Stables 19800 Skipper Road, North Fort Myers 33917 and/or Reign Equestrian 50552 Bermont Road Punta Gorda, Fl 33982 or any of its Volunteers, Employees, Contractors, Associates and Assistants from any and all claims, including but not limited to bodily injury, death, and/or loss suffering during in connection with the activity and/or event.
 

3. Hereby consent to being photographed, video and audio recorded by REq, REq additional trainer/s or any of its Volunteers, Employees, Contractors, Associates and Assistants, or vendor while participating in or attending any REq event or activity, individual or group lesson, on or off property. You agree that all photographs, videos, and audio recordings are and shall remain the
sole property of REq for ever. Any controversy or claim arising out of or relating to this Release and Hold Harmless shall be settled by arbitration only and all arbitration hearing shall take place in Charlotte or Lee County, Florida before a single arbitrator. I hereby irrevocably wave, to the fullest
extent permitted by applicable law, any right I may have to a trial by jury in any legal processing directly or indirectly arising out of or related to this Release and Hold Harmless agreement. Judgment on the award rendered by the arbitrator may be entered in any
court having jurisdiction thereof.
 

WARNING:
UNDER FLORIDA LAW, AN EQUINE ACTIVITY SPONSOR OR EQUINE PROFESSIONAL SHALL NOT BE LIABLE FOR ANY INJURY TO, OR THE DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISK OF EQUINE ACTIVITIES.
